Malawi | Who is exempt from NPS?

As per Section 11(1) of the Pensions Act, the Minister, in consultation with the Minister responsible for Labour and with the Registrar, may, by order published in the Gazette, exempt any class or category of employers or employees from complying with the requirements of this Part.

As per the Pension (Salary Threshold and Exemptions) Order, 2011, Subsection 4, the following classes or categories of employers and employees set out in the Schedule hereto shall be exempt from the application of the Act:
  • Seasonal Employees; 
  • Tenants; 
  • Expatriate employees in possession of temporary employment permit 
  • Members of Parliament in their capacity as such; and
  • Domestic workers.
