Leave | Statutory Sick Pay

Overview

Employees are entitled to £109.40 per week Statutory Sick Pay (SSP) if they are too ill to work and is paid by the employer for up to 28 weeks.

Employees cannot get less than the statutory amount,  but can get more if the company has a sick pay scheme (or ‘occupational scheme’) - specified on the employment contract.

Note!
      Employees who receive Statutory Maternity Pay does not qualify for Statutory Leave Pay (SSP).

Details

Pay Eligibility

To qualify for Statutory Sick Pay (SSP) employees should meet the following criteria:

      1. Be classed as an employee and have done some work for the employer.
      2. Earn an average of at least £123 per week.
      3. Have been ill for at least 4 days in a row (including non-working days).

Note!
      Agency workers are entitled to Statutory Sick Pay.

If eligible, employees are paid Statutory Sick Pay for all the days they're off sick that they normally would have worked, except for the first 3.

Employees will only be paid Statutory Sick Pay for the first 3 working days based on the below conditions:

      1. The period the employee was away from work started before 25 March 2022 and they were off sick due to the coronavirus (COVID-19)
      2. The employee received Statutory Sick Pay within the last 8 weeks, and that already included a 3-day waiting period before they were paid Statutory Sick Pay.

If the employee does not qualify for Statutory Sick Pay, the employer is required to send the SSP1 form within 7 days of the employee going off sick.

Statutory Sick Pay Calculation


Employees may receive £109.40 a week Statutory Sick Pay (SSP) for up to 28 week (maximum).

Tax and National Insurance will be deducted from the Statutory Sick Pay. Employees may receive more pay if the employer has a company adoption pay scheme, however, employers cannot pay less than the statutory amount.
