Kenya - High Court declares 'Affordable Housing Levy' unconstitutional
On Tuesday 28th November 2023, Kenya's High Court declared the 1.5% levy intended to fund affordable housing unconstitutional. The High Court has stayed the ruling until the 10th January 2024 to allow for the Government to appeal. This means the ruling has no immediate effect and Kenyan's can be expected to contribute for at least one more month.
UPDATE: On Wednesday, 3rd January 2024, the Court of Appeal in Kenya ruled to continue the stay on the High Courts ruling that the affordable housing levy was unconstitutional until the 26th January 2024, when a final ruling is expected on the matter. This means Kenyan's can be expected to contribute for at least one more month.
